In a new memo flowing from President Obama’s annoucement, adult children of U.S. Citizens and spouses and children of Lawful Permanent Residents will now be able to take advantage of the provisional waiver program first announced in 2013. These changes under the President’s November 20th, 2014 executive action will also include a clarification of the definition of “extreme hardship” which is a requirement under the provisional waiver program which has been mysterious and challenging for many practitioners to date. This new guidance will greatly help in the process of applying for Lawful Permanent Resident status and the required waiver for unlawful presence the provisional waiver program provides for. The inclusion of these new potential beneficiaries under the executive action announcement and the November 20th, 2014 memo will help many undocumented people apply with their loved ones who could not previously apply for the program.
